Douglas Shire Council said it was preparing to remove the tree on Monday. The works were previously placed on hold after council voluntarily agreed to maintain the status quo while the matter was before the Supreme Court.

Ms Capogreco said she regretfully “discontinued the legal proceedings regarding our beloved fig tree”.

“Progressing to a final hearing would have created a significant financial risk and burden to myself as a private citizen. I apologise for any distress this may cause,” she said.

“After receiving advice from a Brisbane-based barrister, who considered my initial application and the subsequent evidence, it was suggested that the best course of action was for me to withdraw my initial application to the Supreme Court.”

Ms Capogreco said she would refund any GoFundMe donations by contacting her via email: melinacapo15@gmail.com

Mayor Lisa Scomazzon said the decision to remove the tree had never been taken lightly.

“I understand many people feel a deep connection to this tree and those feelings are respected,” she said.

“I’ve been touched by the many stories and memories people have shared. It is connected to special moments in their lives and we understand there is genuine sadness about losing this tree and we share that sentiment.”

Cr Scomazzon said safety remained council’s number one priority.

“Rex Smeal Park is one of our most loved and most visited public spaces and council has a responsibility to ensure it remains safe for everyone who uses it,” she said.
